Gary Green and Joshua Palmer recently ran a successful appeal for a client who wanted to make alterations and additions to their family home, a Victorian-era terrace house, in highly valuable and heritage protected, Paddington.
The Council claimed the changes to the building would affect the contributory value of the house based upon its relationship to the surrounding buildings, particularly the adjoining partner terrace. As such, Council deemed the application not compatible with the “desired future character of the area”.
The Commissioner in approving the development found that as the alterations were to the rear of the building, and the heritage significance was derived primarily from the building’s presence in the streetscape, then aesthetically modern development to the rear of the premises, was not incompatible.
Pikes and Verekers Lawyers have a wealth of experience in running appeals concerning development relating to demolition and renovations to varieties of buildings (both heritage items and contributory items) within Heritage Conservation Areas all around NSW.
