Amendments to Compulsory Acquisition Law

The Land Acquisition (Just Terms Compensation) Amendment Act 2016 commenced on 1 March 2017.

The key amendments are:

1.   A 6 month minimum negotiation period prior to compulsory acquisition.

2.   An increase in the maximum payment for “disadvantage resulting from relocation” in relation to compulsory acquisition of a principal place of residence from
     $27,235.00 to $75,000.00.

3.   A right to seek a review for unsuccessful hardship applications.

4.   Exemption from paying rent for a principal place of residence for 3 months after acquisition.

5.   Reinstatement costs in respect of land used for limited specific purposes where there is no general market for that land.
