Mikaela works closely with Robert Tassell, Mark Green and Brian Walton in the Litigation & Dispute Resolution team in a broad litigation practice including:

  • contract disputes, both seeking to enforce and overturn;
  • directors' disputes and corporate governance disputes; 
  • shareholder disputes;
  • disputes involving competing property interests;
  • bankruptcy and insolvency;
  • family provision claims; and 
  • advising clients including local Council's on debt recovery options following successful judgment. 

​Mikaela commenced employed at Pikes and Verekers Lawyers in July 2018 following completion of her Practical Legal Training. 

Mikaela appears regularly in the Local, District, Supreme and Federal Courts in case management and interlocutory applications and instructs Counsel where appropriate. 

 

Experience

  • Successful defence, working alongside Rob Tassell, of multiple claims for accessorial liability for breach of director's and fiduciary duties alleged over 25 years, involving allegations up to 35 years old and multiple parties over a 23 day trial in the Supreme Court of Victoria: Finance & Guarantee Company Pty Ltd v Auswild [2019] VSC 664. An appeal was lodged but then abandoned. 
  • Successful Third Party Notice application, working alongside Rob Tassell, third parties ordered to reimburse the plaintiff companies in related proceedings in an 11 day trial in the Supreme Court of Victoria: JAB Nominees (Aust) Pty Ltd (ACN 603 601 944) as Trustee for the G Bergmuller No 2 Will Trust & ORs v James Auswild & ORs [2020] VSC 731. 
  • Advised, commenced and settled proceedings pursuant of Part X1 of the Bankruptcy Act 1966, recovering a debt owed to a creditor by having the estate administered in bankruptcy.
  • Advised, commenced, settled and recovered money owed to a creditor pursuant to the Bankruptcy Act 1966
  • Advised a defendant personal injury law firm in representative proceedings brought on behalf of a former client in the federal Court. 
  • Successful opposition of preliminary discovery application in the Federal Court. 
  • Successful civil enforcement proceedings in Class 4 of the Land & Environment Court.
  • Advising on appeal prospects in the NSW and Victoria Court of Appeal.
  • Advised, commenced and settled proceedings against a Financial Advisory firm is respect of misleading and deceptive conduct by the financial firm and it's employed advisors over a period of 7 years.
  • Advised, defended and settled proceedings involving breaches of the Public Interest Disclosure Act 2013
  • Advising and acting for clients in AFCA mediations.
